Introduction
Virtunity ("we," "us," "our," or "Company") respects your privacy and is committed to protecting your personal data. This privacy policy explains how we collect, use, disclose, and safeguard your information when you visit our website and use our iOS application (collectively, the "Service").
Please read this privacy policy carefully. If you do not agree with our policies and practices, please do not use our Service. By accessing or using Virtunity, you acknowledge that you have read, understood, and agree to be bound by all the provisions of this privacy policy.
Information We Collect
Email Address
When you sign up for early access through our waitlist form, we collect your email address. This is required to provide you access to the Service and to send you account-related communications.
Instrument Selection
You may optionally provide information about your primary musical instrument (e.g., clarinet, flute, trumpet). This helps us personalize your experience and tailor exercises and recommendations to your instrument.
Audio Data
The Virtunity app records audio when you play your scales and exercises for session feedback. Audio is processed locally on your device and is not stored on our servers unless you explicitly choose to save a recording. Recordings you save are stored securely in Firebase Cloud Storage. Audio is never used for machine learning training beyond improving session feedback algorithms for your own practice.
Practice Metrics
We collect practice performance data including pitch accuracy scores, rhythm scores, timing data, exercise completion, and practice session history. This data helps personalize your practice plans and track your progress over time.
Usage Analytics
We collect information about how you interact with our Service, including features used, practice frequency, session duration, and exercise completion. This helps us understand how users engage with Virtunity and identify areas for improvement.
Device Information
We collect basic device identifiers, app version, iOS version, and device model for troubleshooting and analytics purposes only.
How We Use Your Information
Virtunity uses collected data to:

- •Send confirmation emails and transactional communications related to your account
- •Send product updates, feature announcements, and early access invitations

Email Communications
When you join our waitlist, we will send you a confirmation email to verify your email address. We may also send you emails about:
- •Early access invitations and TestFlight codes
- •Important product updates and feature releases
- •Tips and resources for audition preparation
- •Account notifications and security alerts
You may opt out of promotional emails by clicking the unsubscribe link in any email or by contacting us at hello@virtunity.io. However, you cannot opt out of transactional emails related to your account or legal compliance.
Data Storage & Security
Your personal data is stored securely using the following infrastructure:
- •Firebase (Authentication, Firestore database, Cloud Storage) — encrypted in transit and at rest
- •Supabase (waitlist data, feature requests) — encrypted in transit and at rest
- •All data encrypted using industry-standard HTTPS and AES encryption
We implement appropriate technical and organizational measures to protect your data against unauthorized access, alteration, disclosure, or destruction. However, no method of transmission over the Internet or electronic storage is 100% secure. While we use reasonable efforts to protect your information, we cannot guarantee absolute security.
Email Service Provider
We use Resend as our email service provider for sending confirmation emails, early access notifications, and product updates. Resend has access to your email address solely for the purpose of delivering emails on our behalf. We have a Data Processing Agreement in place with Resend to ensure your data is handled appropriately.
Cookies & Tracking
Our website may use cookies and similar tracking technologies to enhance your browsing experience and collect analytics. These cookies help us understand traffic patterns, personalize content, and measure the effectiveness of our marketing efforts.
You can control cookies through your browser settings. However, disabling cookies may affect the functionality of our website.
Analytics
We may use analytics tools to better understand how users interact with our Service. These tools collect anonymized and aggregated data about usage patterns, feature adoption, and user engagement. This information is used solely to improve our Service and is not used to identify individual users.
Data Sharing & Third-Party Services
We do not sell, trade, or rent your personal information to third parties.
We may share your information with trusted service providers who help us operate our Service, including:
- •Firebase by Google (authentication, database, cloud storage, analytics) — processes account data, practice metrics, and saved recordings
- •Supabase (waitlist database, feature requests) — processes email addresses and feedback submissions
- •Resend (transactional email delivery) — processes email addresses to deliver account notifications and educational content
- •Apple (App Store, in-app purchases, StoreKit) — processes subscription and payment data
We require all service providers to agree to maintain the confidentiality and security of your personal data and to use it only for the purposes specified.
We may also disclose your information if required to do so by law, or if we believe in good faith that such disclosure is necessary to comply with legal obligations, enforce our terms, or protect the safety and rights of our users and the public.
Children's Privacy (COPPA)
Virtunity is designed for band students in middle school and high school (ages 10–18). We comply with the Children's Online Privacy Protection Act (COPPA) and take children's privacy seriously.
Students under 13: Must have verifiable parental or guardian consent before creating an account. We collect only the minimal personal information needed to provide the Service (email address, instrument selection, practice data). We do not share children's data with third parties for marketing purposes.
Students 13–17: May create accounts with implicit parental knowledge. We recommend parents discuss online privacy and our practices with their children.
Parental Requests: Parents or guardians can request access to, correction of, or deletion of their child's data at any time by contacting hello@virtunity.io. We respond within 48 hours and complete deletions within 30 days. If we discover that we have collected information from a child under 13 without verifiable parental consent, we will delete such information immediately.
Consent Verification: For students under 13, we use email-based parental consent verification. During account creation, a parent or guardian must provide their email address and confirm consent via a verification link before the student can access the Service. We retain a record of this consent for the duration of the account. Parents can withdraw consent at any time by contacting hello@virtunity.io.
Data Minimization for Minors: For students under 13, we collect only the minimum data necessary to provide the Service: email address (parent-verified), instrument selection, and practice performance data. We do not collect location data, contact lists, photos, or any data beyond what is required for audition preparation feedback.
Teacher Data & Dashboard
As connected teacher access rolls out in early access, classroom teachers may view aggregated student data to support instruction. Teachers will see:
- •Student practice frequency (how often each student practiced)
- •Practice scores and performance trends over time
- •Overall progress and improvement metrics
Teachers will NOT have access to: Audio recordings, session student sessions, or any identifiable personal information beyond what is necessary to support classroom instruction.
Teacher accounts are separate from student accounts and require school or district administrator approval. School and district administrators control which teachers have access to which student data and can revoke access at any time.
Data Isolation: Teachers can only view data for students who are explicitly linked to their account via invite codes. A teacher cannot access data for students assigned to other teachers, even within the same school. Cross-teacher data sharing is not supported.
FERPA Compliance: When Virtunity is used in a school setting, student practice data may constitute education records under the Family Educational Rights and Privacy Act (FERPA). Schools and districts deploying Virtunity should treat student practice data as education records and ensure their use of Virtunity complies with FERPA requirements. Virtunity acts as a "school official" with a legitimate educational interest when processing student data on behalf of a school.
Auto-Renewable Subscriptions & Apple App Store
Virtunity offers optional auto-renewable subscriptions through Apple's In-App Purchase system. This section discloses the terms required by Apple and applicable law.
Automatic Renewal
Your subscription will automatically renew at the end of each billing period (monthly, unless otherwise selected) unless you or Virtunity cancels it. By enabling auto-renewal, you authorize Apple to charge your iTunes Account on a recurring basis.
Billing
Payment will be charged to your Apple iTunes Account at confirmation of purchase. Your subscription will be charged at the subscription price (e.g., $9.99/month for Pro, $19.99/month for Premium, or custom pricing if offered) every month (or other billing interval you select) unless and until you cancel your subscription.
Cancellation & Renewal
To cancel auto-renewal, open your Apple iPhone or iPad, go to Settings, select iTunes & App Store, tap your Apple ID, select View Apple ID, select Subscriptions, find Virtunity, and tap Edit. You can then select "Cancel Subscription." Cancellation takes effect at the end of your current billing period. Your access to Pro or Premium features will continue through the end of the paid period.
Free Trial & Trial Cancellation
If Virtunity offers a free trial, your free trial period will end and your paid subscription will begin unless you cancel before the trial period ends. Any unused portion of a free trial period will be forfeited when you purchase a subscription to that publication or service.
Price Changes
Virtunity may change subscription prices at any time. If we change our prices, you will receive notice of the change in your subscription management page at least 30 days before the change takes effect. Continued use of the Service after the price change constitutes your acceptance of the new pricing. If you do not accept the new price, you may cancel your subscription.
Refunds
Subscription refunds are handled by Apple according to Apple's standard subscription refund policy. For refund requests, contact Apple directly at https://support.apple.com/en-us/HT204084. Virtunity does not manage refunds; Apple processes all refund requests for in-app purchases.
Audio Recording Policy
Virtunity processes audio to provide session feedback on your playing. Here's how we handle it:
- •Audio is analyzed on your device for immediate pitch, rhythm, and timing feedback
- •Recordings you save are stored securely in Firebase Cloud Storage
- •Audio is NEVER used to train machine learning models
- •Audio is NEVER shared with third parties
- •You can delete any saved recording at any time through the app
Data Retention
We retain your personal data according to the following schedule:
- •Active accounts: Data is retained while your account is active
- •Inactive accounts: If your account is inactive for 12 months, we will email you before deleting your data
- •Deleted accounts: All data is purged within 30 days of account deletion
- •Backup copies: We may retain data in encrypted backups for up to 90 days
We may retain certain information longer if required by law or to resolve disputes.
Data Deletion Requests
You can request deletion of your account and all associated data at any time. To request deletion:

- •We will respond within 48 hours to confirm
- •Complete deletion is processed within 30 days
Your Privacy Rights
Depending on your location, you may have the following rights:

- •Opt-out: Opt out of promotional communications and non-essential data collection

California & International Privacy Rights
California Residents (CCPA/CPRA): If you are a California resident, you have additional rights under the California Consumer Privacy Act (CCPA) and California Privacy Rights Act (CPRA), including the right to know what personal information we collect, the right to delete your personal information, and the right to opt out of the sale of personal information. Virtunity does not sell personal information. To exercise your rights, contact hello@virtunity.io.
European Residents (GDPR): If you are located in the European Economic Area (EEA), you have additional rights under the General Data Protection Regulation (GDPR), including the right to access, rectify, erase, restrict processing, and data portability. Our legal basis for processing your data is your consent (for account creation) and legitimate interest (for service improvement). To exercise your GDPR rights, contact hello@virtunity.io. You also have the right to lodge a complaint with your local data protection authority.
Changes to This Privacy Policy
We may update this privacy policy from time to time to reflect changes in our practices, technology, legal requirements, or other factors. We will notify you of material changes by posting the updated policy on our website and updating the "Effective date" above. Your continued use of the Service after such modifications constitutes your acceptance of the updated policy.
