Acceptance of Terms
By accessing, downloading, or using Virtunity (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree with these Terms, do not use the Service. Virtunity reserves the right to modify these Terms at any time. Changes are effective immediately upon posting to the website or app. Your continued use of the Service constitutes acceptance of any modified Terms.
Description of Service
Virtunity is an iOS application designed to help band students prepare for auditions. The Service provides:
- •Session scoring of scales and exercises based on pitch accuracy, rhythm, and timing
- •Daily personalized practice plans based on your performance
- •Progress tracking and analytics to monitor improvement over time
- •Instrument-specific content and exercises
- •Educational resources and audition preparation guides
The Service is currently in early access. Features, functionality, and pricing are subject to change at any time. Virtunity makes no guarantee of specific features, availability, or performance.
Age Requirements
Virtunity is designed for band students ages 10–18. Account creation requires:
- •Users under 13: Verifiable parental or guardian consent
- •Users 13–17: May create accounts with implicit parental knowledge (we recommend discussing online privacy)
- •Users 18+: May create accounts without parental consent
You cannot use the Service if you are under 10 years old. All account creation requires a valid email address.
User Accounts
To use the Service, you must create an account by providing your email address and optionally your instrument. You agree to:
- •Provide accurate and complete information
- •Keep your account credentials confidential
- •Be responsible for all activity under your account
- •Notify us immediately if you suspect unauthorized access
- •Not share your account with other users
Virtunity reserves the right to terminate accounts that violate these terms.
User Roles
Virtunity supports three user roles, each with different permissions and responsibilities:
Student
Students use Virtunity to practice scales and exercises, receive session feedback on pitch, rhythm, and timing, and track their progress over time. Students own their practice data and audio recordings. Students may be linked to a teacher account via an invite code provided by their band director.
Teacher
Teachers use Virtunity to monitor student practice activity, assign exercises, conduct lessons, and view aggregated progress metrics. Teachers can only view data for students who have accepted their invite code. Teachers may not export, share, or redistribute individual student data outside of the Virtunity platform. Teachers are responsible for using student data solely for instructional purposes.
Parent or Guardian
Parents or guardians may provide consent for students under 13 to create accounts. Parents can request access to, correction of, or deletion of their child's data at any time by contacting hello@virtunity.io. Parents do not have direct access to the Virtunity app dashboard but may review their child's practice data upon request.
Classroom & Institutional Use
Schools, school districts, and music education programs may deploy Virtunity for classroom use. When Virtunity is used in an institutional setting:
- •Student accounts remain individually owned — students retain ownership of their practice data even if they leave the institution
- •Teachers access student data only through the Virtunity teacher dashboard and only for students who have accepted their invite code
- •Schools and districts are responsible for obtaining parental consent for students under 13, in compliance with COPPA and FERPA
- •Virtunity does not enter into separate institutional licensing agreements at this time — each user creates an individual account
- •Institutional administrators do not have direct access to individual student data through Virtunity
FERPA Compliance: When student practice data constitutes education records under the Family Educational Rights and Privacy Act (FERPA), schools and districts deploying Virtunity must ensure their use complies with FERPA requirements. Virtunity acts as a school official with a legitimate educational interest when processing student data on behalf of a school or district.
Teacher Responsibilities
Teachers who use the Virtunity teacher dashboard agree to:
- •Use student practice data solely for instructional purposes related to music education
- •Not share, export, or redistribute individual student data outside of the Virtunity platform
- •Not use student data for any purpose unrelated to the student's music education
- •Comply with all applicable privacy laws (including FERPA and COPPA) when accessing student data
- •Report any suspected data breach or unauthorized access to Virtunity immediately at hello@virtunity.io
Violation of these responsibilities may result in termination of the teacher's account and revocation of access to student data.
User Content & Intellectual Property
Your Ownership
You retain all rights to any audio recordings, musical performances, or other content you create or upload to the Service ("User Content"). You own your practice recordings, and Virtunity does not claim ownership of your musical performances.
License to Virtunity
By uploading or creating User Content within Virtunity, you grant us a limited, non-exclusive, royalty-free license to process, analyze, and store your audio recordings solely to provide session feedback and generate practice plans. We will not reproduce, distribute, publicly display, or sell your audio without your explicit consent. Audio is not used for machine learning model training.
Virtunity's Intellectual Property
All content, features, functionality, algorithms, designs, and materials associated with Virtunity are owned by Virtunity or its licensors and are protected by copyright, trademark, and other intellectual property laws. You may not reproduce, modify, distribute, or exploit any Virtunity content without express written permission.
Exercise Content License
Virtunity owns all exercise content, scales, technical studies, and instructional materials provided in the app. This content is licensed for your personal practice use only. You may not reproduce, distribute, modify, or share exercise content outside of personal practice on the Virtunity platform.
User-Generated Content Restrictions
You agree not to upload or create User Content that:
- •Is non-music audio (speech, noise, etc.) unrelated to practice
- •Infringes on others' intellectual property rights
- •Contains hate speech, harassment, or abusive language
- •Is obscene, defamatory, or illegal
- •Violates any applicable laws or regulations
Acceptable Use
The Service is designed for legitimate music practice purposes. You agree to:
- •Use the Service only for personal practice and audition preparation
- •Not share your account with other users
- •Not use automated tools, bots, or scrapers to access the Service
- •Not attempt to upload non-music audio or abuse the platform
Prohibited Uses
You agree not to:
- •Use the Service for illegal purposes or in violation of any laws
- •Reverse engineer, decompile, or attempt to discover the underlying code or algorithms
- •Use automated tools, bots, or scrapers to access the Service
- •Attempt to gain unauthorized access to the Service or other users' accounts
- •Transmit malware, viruses, or harmful code
- •Harass, threaten, or defame other users
- •Impersonate others or misrepresent your identity
- •Interfere with or disrupt the Service or its infrastructure
Subscription Terms
Virtunity offers the following subscription tiers (pricing subject to change):
- •Free: Limited assessments per week, no personalized practice plans
- •Pro ($9.99/month): Weekly practice plan generation based on your performance
- •Premium ($19.99/month): Daily practice plan generation and priority support
Auto-Renewable Subscriptions
Subscriptions are managed through Apple App Store In-App Purchases and are auto-renewable. This means:
- •Your subscription will automatically renew at the end of each billing period unless you or Virtunity cancels it
- •Your iTunes Account will be charged for renewal within 24 hours before the end of your current subscription period
- •The cost of renewal is the same as the original subscription price unless otherwise noted
Cancellation
You can cancel your subscription anytime through your App Store account settings:
- Open Settings on your iOS device
- Tap [Your Name] at the top
- Select iTunes & App Stores
- Tap your Apple ID at the top of the screen
- Select View Apple ID (you may need to sign in)
- Scroll down and tap Subscriptions
- Tap Virtunity
- Select Cancel Subscription
Cancellation takes effect at the end of your current billing period. You will retain access to Pro or Premium features through the end of the paid period.
Free Trial
If Virtunity offers a free trial subscription, your trial period will end and a paid subscription will begin unless you cancel before the trial ends. Any unused portion of a free trial period will be forfeited when you purchase a subscription.
Price Changes
Virtunity may change subscription prices at any time. We will provide at least 30 days' notice before the change takes effect by updating the price on your Subscriptions page in your Apple ID settings. Continued use of the Service after a price change constitutes acceptance of the new price. If you do not accept a price increase, you may cancel your subscription.
Refunds
Refunds for subscription purchases are handled by Apple according to Apple's subscription refund policy. Contact Apple directly at https://support.apple.com/en-us/HT204084 for refund requests. Virtunity does not handle subscription refunds.
No Refund for Unused Time
We do not offer refunds for partial months or unused subscription time. If you cancel mid-month, you will retain access through the end of your current billing period.
Teacher Dashboard Access
The Virtunity teacher dashboard is available at no additional cost to band directors. Teachers gain access to the dashboard by creating a teacher account. The teacher dashboard provides class management, lesson tools, and student progress visibility. Teacher dashboard features may change as the Service evolves.
Service Availability
Virtunity is currently available on iOS. We are working toward expanding to other platforms in the future, but make no guarantees about platform expansion, timeline, or feature parity.
- •Internet connection is required for most features
- •Offline practice mode is available with limited features (local analysis only)
- •We aim for 99.5% uptime but do not guarantee continuous service
- •Scheduled and emergency maintenance may temporarily interrupt service
Service Changes & Modifications
The Service is provided "AS-IS" during early access. Virtunity reserves the right to modify, suspend, or discontinue any feature or the entire Service. We may, at our sole discretion:
- •Change pricing, features, or subscription terms (with notice when possible)
- •Modify exercise content, scoring algorithms, or practice plans
- •Remove or restrict access to content or accounts that violate these Terms
- •Perform maintenance that may temporarily interrupt service
Virtunity will not be liable for any losses resulting from scheduled or unscheduled downtime, service interruptions, or feature changes.
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
- •Virtunity and its founders, employees, and partners shall not be liable for indirect, incidental, special, consequential, or punitive damages
- •We are not responsible for loss of data, profits, revenue, or business opportunities
- •Our total liability shall not exceed the amount you paid to Virtunity in the past 12 months (or $0 if you haven't paid)
- •Some jurisdictions do not allow limitations on liability, so this provision may not apply to you
Content Ownership
Your Data: You retain ownership of your practice recordings, practice data, and performance metrics. You can delete any recording or account data at any time.
Virtunity's Ownership: Virtunity owns the app, algorithms, exercise library, scoring system, and all proprietary content. You may not reproduce, modify, or distribute Virtunity's content or algorithms.
Disclaimers
Not a Substitute for Professional Instruction: Virtunity provides practice feedback and planning tools designed to complement private lessons with qualified teachers. The Service is an assistant to your practice routine and does not replace professional music instruction. Audition outcomes depend on many factors beyond the scope of this app, including teacher guidance, personal practice discipline, and musical development.
Accuracy Limitation: While Virtunity uses advanced audio processing to score your performances, the scoring is algorithmic and may not always match the assessment of a professional musician or teacher. Virtunity does not guarantee the accuracy of feedback or scoring. Use feedback as a guide, not absolute truth.
No Audition Guarantees: Virtunity is not responsible for audition outcomes, acceptances, rejections, or any competitive results. Using Virtunity does not guarantee success in auditions or music education programs.
No Medical or Health Advice: Virtunity does not provide medical, health, or physical therapy advice. If you experience physical pain or injury while playing, consult a qualified healthcare professional immediately.
Fundamentals Focus: Virtunity is designed to help students develop the fundamental, measurable aspects of instrumental performance — pitch accuracy, rhythm, timing, and scale fluency. Virtunity does not teach musicality, phrasing, dynamics, expression, or artistic interpretation. These aspects of music education require a qualified teacher and cannot be replaced by technology. Virtunity is a tool that supports teachers by handling the objective, data-driven elements of practice so teachers can focus on artistry.
Indemnification
You agree to indemnify, defend, and hold harmless Virtunity and its founders, employees, and partners from any claims, damages, losses, or expenses (including attorney fees) arising from:
- •Your use or misuse of the Service
- •Your violation of these Terms
- •Your User Content or intellectual property infringement
- •Your violation of any third-party rights
Termination
Virtunity may terminate or suspend your account and access to the Service immediately, without notice or liability, for any reason, including if you violate these Terms. Upon termination, your right to use the Service ceases immediately.
You may terminate your account at any time by contacting us at hello@virtunity.io. Upon termination, your data may be deleted in accordance with our Privacy Policy.
Third-Party Links & Services
The Service may contain links to third-party websites and services that are not operated by Virtunity. We are not responsible for the content, accuracy, availability, or practices of third-party services. Your use of third-party services is governed by their own terms and privacy policies, not ours.
Governing Law
These Terms are governed by and construed in accordance with the laws of the State of Illinois, without regard to its conflict of law provisions. Any disputes arising from these Terms or the Service shall be brought exclusively in the state or federal courts located in Cook County, Illinois. You agree to submit to the personal jurisdiction of such courts.
Severability
If any provision of these Terms is found to be invalid or unenforceable, that provision shall be severed, and the remaining provisions shall remain in full force and effect.
Entire Agreement
These Terms, along with our Privacy Policy, constitute the entire agreement between you and Virtunity regarding your use of the Service. These Terms supersede all prior agreements, understandings, and negotiations.
Changes to These Terms
We may update these Terms at any time. Changes are effective immediately upon posting. We will notify users of material changes by updating the "Effective date" and, when appropriate, by posting a notice on our website. Your continued use of the Service after modifications constitutes your acceptance of the updated Terms.
