Terms of Service

Agreement

These terms govern use of the Virtunity website, the Virtunity structured-practice app and teacher tools, First Five Notes by Virtunity, and the American Music Appreciation resources. By using a service, you agree to these terms and the Privacy Policy. If you are using a service for a school, studio, or organization, you represent that you are authorized to do so.

First 5 Notes Classroom

First 5 Notes Classroom costs $99 as a one-time payment for a 12-month term. It covers one band program at one school and may be used by unlimited students enrolled in that program and their co-teachers. It unlocks every full-range module currently available in First 5 Notes. Access does not renew automatically.

An invoice request does not activate access. For card checkout, the 12-month term begins when Stripe confirms full payment and Virtunity creates the program. For an invoice or another approved payment method, the term begins when Virtunity independently confirms full payment and activates the program.

Prices exclude applicable sales, use, lease transaction, and similar taxes, which Virtunity will collect when required by law; purchasers must provide accurate billing and software-use information and any applicable exemption documentation before purchase.

The purchaser must be an adult authorized by the school or organization. After verified payment, the purchaser receives a single-use setup link that expires after 30 days and chooses one shared passphrase. Virtunity stores only a slow salted hash of the passphrase, not the passphrase itself. The program code and passphrase may be shared only with enrolled students and co-teachers in the covered program and may not be posted publicly, resold, or shared with another school or program. Credential rotation and revocation are available through Virtunity support.

The term expires automatically after 12 months and does not renew automatically. There is currently no self-service renewal or extension; contact support before expiration to arrange continued access. Expiration is enforced at the stated time. A mid-term revocation or full refund may take up to 24 hours to reach a device that is already offline. We may revoke access for a full refund, payment dispute, payment reversal, material credential misuse, security risk, or a violation of these terms. A partial refund does not automatically end access and may be reviewed by Virtunity support.

Virtunity

Virtunity provides a live practice workflow that includes:

• •Structured practice plans and assigned scales, exercises, and repertoire
• •Practice tools such as a tuner, metronome, drone, rep counter, and notes
• •Practice history and an optional saved final-take recording
• •Connected-teacher assignment, history, and recording-review tools

Virtunity does not currently generate a complete score or evaluation of a musical performance. Scale Checker and other audio-supported capabilities may change as they improve. The service supplements a qualified teacher; it does not replace instruction or guarantee an audition result.

First Five Notes

First Five Notes is an interactive fingering and note-learning product. The core experience does not require an account. Played-note recognition can confirm that the expected note was produced, but it does not score rhythm, tempo, duration, tone, articulation, or a complete performance. The product does not save student recordings.

First Five Notes is live on the App Store, and the browser offers 14 learning paths across 12 beginning-band instrument families, including separate high- and low-bells paths.

The first five notes are free and require no account. A one-time $4.99 website purchase unlocks one instrument’s full beginning range. A one-time $19.99 website purchase unlocks every current and future instrument full range in the web app. Website purchases are not subscriptions. A parent or guardian account is required so a website purchase can be restored on another browser or in the First 5 Notes iPhone app.

Store rules and the purchase screen presented at the time of sale also apply.

First 5 Notes Classroom currently works in the web app. The current iPhone app cannot accept a program code and shared passphrase. The next planned iPhone release will add program sign-in, allowing students and co-teachers covered by an active Classroom purchase to use their program credentials to unlock the full-range content available in the iPhone app.

American Music Appreciation

The American Music Appreciation curriculum, workbook, teacher materials, and interactive resources are provided free for educational use. Unless a resource states otherwise, you may use and reproduce classroom copies for your own students but may not resell, repackage, or publish the materials as your own.

Accounts and roles

Virtunity student and teacher features require an account. Keep credentials confidential and tell us promptly if you suspect unauthorized access. Teachers may access only students who are properly connected to their roster and may use student information only for legitimate instructional purposes.

Virtunity Practice accounts are currently limited to people age 13 or older. The product does not currently offer a parent-consent or school/district authorization path for an under-13 account. Teachers should not assign Virtunity Practice to students under 13 and must follow their organization's approval and student-privacy requirements.

Recordings and other user content

You retain ownership of recordings, notes, and other content you provide. You give Virtunity a limited permission to host, process, and present that content only as needed to operate the service—for example, to play a saved final take for the student and their connected teacher. You represent that you have the rights and permissions needed to provide the content.

Acceptable use

• •Use the services only for lawful educational, practice, and instructional purposes
• •Provide accurate account information and protect account credentials
• •Access only accounts, students, recordings, and information you are authorized to access
• •Respect copyright, privacy, and the rights of other users
• •Do not interfere with the service, bypass security, scrape the service, introduce malicious code, or reverse engineer protected portions of the products except where law permits

We may restrict or terminate access that threatens users, violates these terms, infringes rights, or creates legal or security risk.

Pricing

Virtunity is a student subscription of $79.99 per year or $9.99 per month, one plan with everything included, with a one-month free trial when subscriptions begin. Billing begins with the v1.1 release; until that release, no subscription is charged. Teacher accounts are free.

Individual accounts created on or before August 27, 2026 keep lifetime free access to Virtunity, our thanks to everyone who used Virtunity while it was being built. This promise applies to individual accounts and does not make separately priced products free, including full-instrument First Five Notes purchases and school or classroom deployments arranged with an institution, which are licensed separately.

When subscriptions begin, the price and billing terms will be shown before purchase and these terms will be updated. The service does not offer the paid subscription tiers described in older materials.

Product changes and availability

Products and features may change as we improve reliability and usability. We may modify, suspend, or discontinue features; correct errors; or limit access for maintenance or security. We do not promise uninterrupted availability, a particular device or operating-system lifespan, or exact parity between a demonstration and the live product.

Virtunity materials and intellectual property

The products, branding, software, designs, and original instructional materials are owned by Virtunity or its licensors. These terms grant permission to use the services as offered; they do not transfer ownership or permit resale, copying of software, or unauthorized commercial use.

Disclaimers

The services are provided on an “as available” basis to the extent permitted by law. Educational content and practice tools may contain errors and should be checked against current audition requirements and a qualified teacher's guidance. Virtunity does not guarantee placement, acceptance, improvement, or a specific musical outcome. The products do not provide medical advice; stop and consult a qualified professional if playing causes pain or injury.

Limitation of liability

To the maximum extent permitted by law, Virtunity and its contributors will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost data, revenue, or opportunity arising from use of the services. Any total liability will not exceed the amount paid for the affected service during the twelve months before the claim. Some jurisdictions do not allow certain limits, so these limits may not apply to you.

Changes to these terms

We may update these terms as the products change. The “Last updated” date above identifies the current version. If a change materially affects an account holder, we will provide notice through the website, app, or account email when appropriate.

Governing law

These terms are governed by the laws of the State of Illinois, without regard to conflict-of-law principles. Nothing in these terms limits rights that cannot be waived under applicable law.
