Terms of Service
Effective July 14, 2026
Agreement
These terms govern use of the Virtunity website, the Virtunity structured-practice app and teacher tools, First Five Notes by Virtunity, and the American Music Appreciation resources. By using a service, you agree to these terms and the Privacy Policy. If you are using a service for a school, studio, or organization, you represent that you are authorized to do so.
Virtunity
Virtunity provides a live practice workflow that includes:
- Structured practice plans and assigned scales, exercises, and repertoire
- Practice tools such as a tuner, metronome, drone, rep counter, and notes
- Practice history and an optional saved final-take recording
- Connected-teacher assignment, history, and recording-review tools
Virtunity does not currently generate a complete score or evaluation of a musical performance. Scale Checker and other audio-supported capabilities may change as they improve. The service supplements a qualified teacher; it does not replace instruction or guarantee an audition result.
First Five Notes
First Five Notes is an interactive fingering and note-learning product. The core experience does not require an account. Played-note recognition can confirm that the expected note was produced, but it does not score rhythm, tempo, duration, tone, articulation, or a complete performance. The product does not save student recordings.
First Five Notes Clarinet is live and free on iOS. The first five notes are free, a full-range unlock is $4.99 per instrument, and the web bundle is $19.99. A 10-instrument app is coming. Store rules and the purchase screen presented at the time of sale also apply.
American Music Appreciation
The American Music Appreciation curriculum, workbook, teacher materials, and interactive resources are provided free for educational use. Unless a resource states otherwise, you may use and reproduce classroom copies for your own students but may not resell, repackage, or publish the materials as your own.
Accounts and roles
Virtunity student and teacher features require an account. Keep credentials confidential and tell us promptly if you suspect unauthorized access. Teachers may access only students who are properly connected to their roster and may use student information only for legitimate instructional purposes.
A child under 13 may not create or use a Virtunity account without appropriate authorization from a parent or legal guardian, or an eligible school or district process. An individual teacher signup does not by itself establish school or district authorization. Teachers must follow their organization's approval, consent, and student-privacy requirements.
Recordings and other user content
You retain ownership of recordings, notes, and other content you provide. You give Virtunity a limited permission to host, process, and present that content only as needed to operate the service—for example, to play a saved final take for the student and their connected teacher. You represent that you have the rights and permissions needed to provide the content.
Acceptable use
- Use the services only for lawful educational, practice, and instructional purposes
- Provide accurate account information and protect account credentials
- Access only accounts, students, recordings, and information you are authorized to access
- Respect copyright, privacy, and the rights of other users
- Do not interfere with the service, bypass security, scrape the service, introduce malicious code, or reverse engineer protected portions of the products except where law permits
We may restrict or terminate access that threatens users, violates these terms, infringes rights, or creates legal or security risk.
Pricing
Virtunity is live and free on the App Store today. Accounts registered before a future Virtunity paywall launches will keep lifetime free access to Virtunity. Future subscription pricing has not been set. This promise does not make separately priced products, including full-instrument First Five Notes purchases, free.
If paid Virtunity plans are introduced later, the price and billing terms will be shown before purchase and these terms will be updated. The service does not currently offer paid subscription tiers described in older materials.
Product changes and availability
Products and features may change as we improve reliability and usability. We may modify, suspend, or discontinue features; correct errors; or limit access for maintenance or security. We do not promise uninterrupted availability, a particular device or operating-system lifespan, or exact parity between a demonstration and the live product.
Virtunity materials and intellectual property
The products, branding, software, designs, and original instructional materials are owned by Virtunity or its licensors. These terms grant permission to use the services as offered; they do not transfer ownership or permit resale, copying of software, or unauthorized commercial use.
Disclaimers
The services are provided on an “as available” basis to the extent permitted by law. Educational content and practice tools may contain errors and should be checked against current audition requirements and a qualified teacher's guidance. Virtunity does not guarantee placement, acceptance, improvement, or a specific musical outcome. The products do not provide medical advice; stop and consult a qualified professional if playing causes pain or injury.
Limitation of liability
To the maximum extent permitted by law, Virtunity and its contributors will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost data, revenue, or opportunity arising from use of the services. Any total liability will not exceed the amount paid for the affected service during the twelve months before the claim. Some jurisdictions do not allow certain limits, so these limits may not apply to you.
Changes to these terms
We may update these terms as the products change. The effective date above identifies the current version. If a change materially affects an account holder, we will provide notice through the website, app, or account email when appropriate.
Governing law
These terms are governed by the laws of the State of Illinois, without regard to conflict-of-law principles. Nothing in these terms limits rights that cannot be waived under applicable law.
